Terms and Conditions for Using the Seasonal Color Analysis – Quiz API
Acceptance of Terms
By accessing or using the Seasonal Color Analysis – Quiz API (“API”), you agree to comply with and be bound by these Terms and Conditions. If you do not agree to these terms, you must not use the API.
Intellectual Property Rights
This Agreement does not transfer to you any intellectual property owned by the API provider or third parties, and all rights, titles, and interests in and to such property will remain solely with the API provider. All trademarks, service marks, graphics, and logos used in connection with the API are trademarks or registered trademarks of the API provider or its licensors. Other trademarks, service marks, graphics, and logos used in connection with the API may be the trademarks of other third parties. Your use of the API grants you no right or license to reproduce or otherwise use any API provider or third-party trademarks.
Furthermore, the quiz results derived from the API quiz logic may not be used for training AI models, whether for internal or external use, without prior written consent from Mobile Application Developer. Any attempt to utilize these elements for AI training, data modeling, or similar activities without explicit permission will constitute an infringement of Mobile Application Developer’s intellectual property rights.
The content provided by the API, including but not limited to seasonal type calculations and descriptive texts (collectively, “API Content”), is protected by intellectual property laws and is intended solely for integration into applications as specified by the API’s purpose. These resources, including texts and descriptions of seasonal color types, can only be used within the context of the API. Any use of the API Content beyond its intended purpose, including but not limited to commercial redistribution, derivative works, or use without the API, is strictly prohibited without the prior written consent of the API provider. When API Content is utilized in any manner, it is mandatory that the provider’s name and logo be prominently included in all instances of such use. By using the API Content, you agree to comply with these terms.
Disclaimer of Warranty
You agree that your use of the API is solely at your own risk. The API is provided on an “as is” and “as available” basis. The provider expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
The provider makes no warranty that the API will meet your requirements, be uninterrupted, timely, secure, or error-free, or that the results obtained from the API will be accurate or reliable. You understand and agree that any data transmitted or received through the API is done at your own discretion and risk, and the provider is not responsible for any damage resulting from such data transmission. No advice or information obtained by you from the provider shall create any warranty not expressly stated herein.
We make no warranty and we do not assume any responsibility or liability regarding any goods or services purchased based on any information, colors, or palettes provided by the API.
Limitation of Liability
To the fullest extent permitted by applicable law, in no event will the API provider, its affiliates, officers, directors, employees, agents, suppliers, or licensors be liable to any person for:
(a) Any indirect, incidental, special, punitive, cover, or consequential damages (including, without limitation, damages for lost profits, revenue, sales, goodwill, use of content, impact on business, business interruption, loss of anticipated savings, or loss of business opportunity), however caused, under any theory of liability, including, without limitation, contract, tort, warranty, breach of statutory duty, negligence, or otherwise, even if the API provider has been advised as to the possibility of such damages.
(b) The aggregate liability of the API provider and its affiliates, officers, employees, agents, suppliers, and licensors related to the API will be limited to an amount greater of one dollar or any amounts actually paid in cash by you to the API provider for the prior one-month period preceding the first event or occurrence giving rise to such liability.
The limitations and exclusions also apply if this remedy does not fully compensate you for any losses or fails of its essential purpose.
Severability
All rights and restrictions contained in this Agreement may be exercised and shall be applicable and binding only to the extent that they do not violate any applicable laws and are intended to be limited to the extent necessary so that they will not render this Agreement illegal, invalid, or unenforceable. If any provision or portion of any provision of this Agreement is held to be illegal, invalid, or unenforceable by a court of competent jurisdiction, the remaining provisions or portions thereof shall remain in full force and effect.
Modifications and Updates
The API provider reserves the right to modify, suspend, or discontinue the API or any part of it. The provider may update these Terms and Conditions from time to time. Continued use of the API constitutes acceptance of the revised terms.
The provider may terminate your access to the API at any time if you violate these Terms and Conditions.
